plea bargaining in india
the basic idea of plea bargain in india has been inspired / taken from some western countries. however the legislation has given a unique shape to the whole idia of plea bargain. A short and plain reading of section 265-A to section 265-L of Chapter XXI-A (PLEA BARGAINING) of Code Of Criminal Procedure, 1973 makes it prima-facie clear that the plea bargainign in India does not necessarily include pleading guilty by the accused and also it does not necessarily include the conviction of the accused. it is an adaptation of western plea bargain into indian justice system. A welcome step. what do you say ?
